This document is a Public Offer (hereinafter referred to as the "Offer"), posted on the official website of the law firm "Acceptus", located at https://www.acceptus.legal, having the appropriate legal force in accordance with Articles 234, 237 , 357 and 364 of the Civil Code of the Republic of Uzbekistan, which regulates the Rules for using the possibilities of applying through the website of the law firm "Acceptus". The law firm "Acceptus", represented by the Managing Partner Pashkovsky A.S., acting on the basis of the Charter (hereinafter referred to as the "Firm"), hereinafter referred to as the "Firm", on the one hand, about the intention to conclude an Offer for the processing of personal and professional data ( hereinafter referred to as the "Offer") with the firm (its lawyers), the person who accepted (accepted) this Offer, hereinafter referred to as the "Applicant" on the other hand, and together referred to as the "Parties" for the purpose of a possible subsequent conclusion of the Offer on the provision of legal assistance in the traditional form (off-line) or through the company's online service. Familiarization of the "Applicant" with the Offer (Articles 367 and 369 of the Civil Code of the Republic of Uzbekistan) is carried out by fully familiarizing with the current version of it posted on the company's website at: https://www.acceptus.legal....... This Offer on the processing of personal data was developed in accordance with the Law of the Republic of Uzbekistan "On Personal Data" dated 01.10.2019. Full and unconditional acceptance (acceptance) of the terms of this Offer is considered to be the implementation by the "Applicant" of actions: registration on the website, provision of personal data, putting marks (checkmarks) on agreement with the terms of this Offer.
Confirms the accuracy of his personal data and assumes all responsibility for their accuracy, completeness and reliability; It assumes all possible commercial and other risks associated with its actions to make mistakes, inaccuracies in the provision of information. For the purposes of this Offer, the following basic concepts are used: Firm service - a software and hardware complex (information system) for providing a communication channel between applicants and the firm through the firm's website for the purpose of a possible subsequent conclusion of an Offer for the provision of legal assistance in the traditional form (off-line ) or receiving legal assistance through the online service "Applicants" on the Internet (via the company's website) in real time (online) or deferred legal assistance, using the functionality of the website https://www.acceptus.legal and mobile application "Acceptus" (if available). Applicant - an individual, or a representative of a legal entity, who has the appropriate documented authority to represent a legal entity, who visited the company's website located at the following address on the Web https://www.acceptus.legal, who read and accepted this Offer. Firm - the law firm "Acceptus", the owner of the firm's website, located at the following address on the Web https://www.acceptus.legal, represented by its managing partner and / or lawyers of the firm. Online service of the company - a set of functionality of the company's website located at the following address on the Web https://www.acceptus.legal, which allows the Applicant to remotely contact the company to place commercial offers of cooperation, submit a short question with the aim of subsequently obtaining a qualified legal help.
1.1. The “Applicant” undertakes to provide personal data in accordance with the Offer, and the “Firm” undertakes to process and provide a short answer, on the merits, as well as to make proposals for further provision of legal assistance under the terms of the Offer.
2.1. Rights and obligations of the Applicant:2.1.1. Before concluding the Offer, read and familiarize yourself with the terms of this Offer;2.1.2. When registering on the company's website, indicate true, complete and accurate information about yourself;2.1.3. Agree to the processing of the following personal data of the Applicant, specified in the forms and / or in the files attached to the forms displayed in the online service of the company.2.1.4. When registering in the online service of the company, the Applicant is obliged to accurately and completely indicate his Surname, name (in full, according to the national passport or ID-card), e-mail address, telephone number in international format.2.2. Rights and obligations of the "Firm":2.2.1. Process the personal data of the Applicant, both without the use of automation tools and with their use, and provide a full, motivated response to the appeal within 4 (four) working days (excluding the time for the possible translation of the appeal from a language that the partners of the company and technical failures not dependent on the Company).2.2.2. Save and not transfer to third parties the personal data of the Applicant in any form without the written (in electronic form) consent of the Applicant or his authorized representative.2.2.3. The Firm has the right to refuse further communication to the Applicant, unilaterally with indication of the reasons for such refusal or without it, while maintaining the obligation not to disseminate the Applicant's personal data, minus cases of contacting the authorized bodies for subsequent legal proceedings, in cases of violation of the law or non-payment under the terms of the Legal Assistance Agreement, with reference to this Offer.2.2.4. The Firm, within the framework of this Offer, strives for the most highly qualified, prompt, complete and conscientious provision of legal assistance and the establishment of partnerships.2.2.5. The Firm is not responsible for the actions of the Applicant, and in cases of direct violation of international norms, the current legislation of Uzbekistan and in case of clearly inadequate communication, the Applicant may at any time interrupt or terminate communication in any form with the Applicant and apply to the authorized bodies of the country of registration.
3.1. The Firm under this Offer assumes the obligation to keep confidential information about personal data, attorney-client secrecy of the Applicant and other information obtained at the conclusion of this Offer and not transfer them to third parties by virtue of the Law and this Offer.3.2. The transfer of personal data and information provided to the Applicant to third parties is allowed ONLY with the written (in electronic form) consent of the Applicant.3.3. The Parties undertake to keep confidential information and legal, commercial or other secrets received from the other Party in the execution of this Offer.
4.1. For violation of the terms of the Offer, the parties are liable in accordance with the current legislation of the Republic of Uzbekistan.
5.1. None of the Parties shall be liable for the full or partial failure of the other Party to fulfill its obligations if the failure is the result of force majeure circumstances, such as fire, flood, earthquake, strikes and other natural disasters, war and hostilities, epidemics, epizootics , quarantine restrictions or other circumstances beyond the control of the Parties that prevent the implementation of this Offer.5.2. If any of these circumstances directly affected the failure to fulfill the obligation within the period specified in the Offer, then this period is proportionally postponed for the duration of the relevant circumstance.5.3. The Party for which it has become impossible to fulfill obligations under the Offer is obliged not later than 4 (four) days from the moment of their occurrence and termination in writing (electronic) form to notify the other Party of the occurrence, expected duration and termination of the above circumstances.
6.1. This Offer is a Public Offer between the Applicant and the Firm and its form is located on the firm's website at: https://www.acceptus.legal.6.2. This Offer is concluded in the manner described in its Preamble.6.3. This Offer is concluded for a period of up to 10 (ten) days or until the Parties fully fulfill their obligations. Either Party has the right to cancel this Offer in writing (in electronic form) by notifying the other Party at least 3 (three) working days before such refusal.6.5. All disputes, claims and disagreements that may arise between the Parties will be resolved through negotiations.6.6. If issues are not resolved during the negotiation process, disputes are subject to judicial review, in compliance with claim procedures. The term for consideration of claims is 15 (fifteen) business days from the date of receipt.6.7. The form of electronic communication recognized by the Parties to this Offer is: e-mail with the addresses of the Parties indicated on the website of the company and provided by the Applicant, the mobile application of the company "Acceptus", Telegram-bot and personal correspondence with the contractor (lawyer) of the company in any of the messengers that can be mutually fixed in any form by any of the Parties with the condition of safe storage for up to 15 (fifteen) days and exclusion of distribution to third parties.
